Terms of Service

CSJ Publications ("Locked-Up WV") welcomes you. CSJ Publications provides the Locked-Up WV Services (defined below) to you subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. By accessing and using the Locked-Up WV Services, you accept and agree to be bound by the terms and provision of the TOS.

In consideration of your use of the Locked-Up WV Services, you represent that you are of legal age to form a binding contract and are not a person barred from receiving the Locked-Up WV Services under the laws of the United States or other applicable jurisdiction. You also agree to: (1) provide true, accurate, current and complete information about yourself as prompted by the Locked-Up WV Service's registration form (the "Registration Data") and (2) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Locked-Up WV has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Locked-Up WV has the right to suspend or terminate your account and refuse any and all current or future use of the Locked-Up WV Services (or any portion thereof).

You will receive a password and account designation upon completing the Locked-Up WV Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (1) immediately notify Locked-Up WV of any unauthorized use of your password or account or any other breach of security, and (2) ensure that you exit from your account at the end of each session. Locked-Up WV cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

When you register with Locked-Up WV or submit information to Locked-Up WV, a temporary copy of that information is routinely made to prevent accidental loss of your information through a computer malfunction or human error. Locked-Up WV keeps your account information active in our user registration databases in order to provide immediate access to your personalization preferences each time you visit Locked-Up WV. If you ask Locked-Up WV to delete your Locked-Up WV account, in most cases your account will be deactivated and then deleted from our user registration database in approximately 30 days. This delay is necessary to discourage users from engaging in fraudulent activity. Please note that any information that we have copied may remain in back-up storage for some period of time after your deletion request. This may be the case even though no information about your account remains in our active user databases.

By submitting ideas, suggestions, documents, and/or proposals ("Contributions") to Locked-Up WV through its suggestion or feedback webpages, you acknowledge and agree that: (1) your Contributions do not contain confidential or proprietary information; (2) Locked-Up WV is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (3) Locked-Up WV shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (4) Locked-Up WV may have something similar to the Contributions already under consideration or in development; (5) your Contributions automatically become the property of Locked-Up WV without any obligation of Locked-Up WV to you; and (6) you are not entitled to any compensation or reimbursement of any kind from Locked-Up WV under any circumstances.

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion or use of, or access to, the Locked-Up WV Services.

You agree that all of Locked-Up’s trademarks, trade names, service marks and other Locked-Up WV logos and brand features, and product and service names are trademarks and the property of CSJ Publications-Locked-Up WV (the "Locked-Up"). Without Locked-Up's prior permission, you agree not to display or use in any manner the Locked-Up Marks.

Locked-Up WV reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Locked-Up WV Services (or any part thereof) with or without notice. You agree that CSJ Publications/Locked-Up WV shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Locked-Up WV Services (or any part thereof). Your use of Locked-Up Services and Software are at your sole risk. Locked-Up Services and Software are provided on an “as is” and “as available” basis. Locked-Up and its subsidiaries, affiliates, officers, employees, agents, partners and licensors make no warranty that (1) the Locked-Up Services or Software will meet your requirements; (2) Locked-Up Services or Software will be uninterrupted, timely, secure or error-free; (3) The results that may be obtained from the use of the Locked-Up Services or Software will be accurate or reliable; (4) The quality of any products, services, information or other material purchased or obtained by you through Locked-Up Services or Software will meet your expectations; and (5) Any errors in the software will be corrected.

You may terminate your Locked-Up WV account, any associated email address and access to the Locked-Up WV Services by submitting such termination request to Locked-Up WV. You agree that CSJ Publications may, without prior notice, immediately terminate, limit your access to or suspend your Locked-Up WV account, any associated email address, and access to the Locked-Up WV Services. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (1) breaches or violations of the TOS or other incorporated agreements or guidelines, (2)requests by law enforcement or other government agencies, (3) discontinuance or material modification to the Locked-Up WV Services (or any part thereof), (4) unexpected technical or security issues or problems, (5) extended periods of inactivity, (6) engagement by you in fraudulent or illegal activities, and/or (7) nonpayment of any fees owed by you in connection with the Locked-Up WV Services. No cash or credit card refunds are available on Locked-Up WV Services since all sales are final. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in CSJ Publications/Locked-Up WV sole discretion and that CSJ Publications/Locked-Up WV shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Locked-Up WV Services. Termination of your Locked-Up WV account includes any or all of the following: (1) removal of access to all or part of the offerings within the Locked-Up WV Services, (2) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (3) barring of further use of all or part of the Locked-Up WV Services.

All content provided in Locked-Up is considered public in nature and is made available as a public service in the interest of public safety. Locked-Up assumes all records collected are accurate but does not guarantee accuracy. Any corrections or complaints should be directed to the department or agency providing said records. The information in this publication provides only booking records for said individuals. All individuals in this publication are considered innocent until proven guilty in a court of law. The individuals listed in the Sexual Offenders Sections may have more than one address or place of employment. Sexual Offenders have prior arrest and conviction dates and are required to register in compliance with the West Virginia Sex Offender Registration Act. Positive identification of a sexual offender cannot be established unless a fingerprint comparison is made. West Virginia Sex Offender Registration Act (W.Va. Code §15-12) requires registration from any person who has been convicted of a “qualifying offense” under (W.Va. Code §61-8B) or under a statutory provision of another state. Any person that is required to register must do so upon conviction unless that person is incarcerated. However, that person must register within three business days after release. In addition, any person convicted of a qualifying offense, including persons who are granted probation, suspended sentences, released on parole, work release, home detention, conditional release or any other release from confinement, must also register. This law is both prospective and retroactive. See (W.Va. Code §15-12) for additional information regarding sexual offenders.
